1. About Tamborileo.

1.1The Services.

LGUC Inc. (“LGUC,” “Tamborileo” “Us” or “We”), is committed to protecting your privacy. We make available the Tamborileo websites located at www.tamborileo.com and app.tamborileo.com including all subpages and successor pages (together, the “Website”), and the Tamborileo applications (the “Tamborileo App”), together with our Services as further described in our Terms of Service (the “Services”).

1.2 Users.

The Tamborileo Website and App allows users seeking to solicit designs, fabric supplies and production facilities (in each case, a “Buyer”) to use the Services to make purchases from Brands, Suppliers, Factories or Retailers (each a “Vendor”). We refer to Buyers, Vendors and other visitors and browsers of the Services collectively as “Users”. This Privacy Policy applies to all Users as well as anyone who visits our Website.

2. Your Consent

By using the Website, the App or our Services, you consent to the use of your Personal Information, as described in this Privacy Policy. Except as set forth in this Privacy Policy, your Personal Information will not be used for any other purpose without your consent. You may withdraw your consent to our processing of your Personal Information at any time. However, withdrawing consent may result in your inability to continue using the Website, App and/or the Services.

3. Our Privacy Statement

3.1 Application.

This Privacy Policy describes how We collect, use and disclose information about our Users through the Website and Services. We aim to collect, use and disclose only Personal Information as is required to enable Us to manage your account (as defined in our Terms of Service), to provide the Services, including connecting Buyers and Vendors, processing purchase orders and delivering purchased goods, maintaining our customer/visitor lists, responding to your inquiries or provide feedback, for identification and authentication purposes and for service improvement.

Two types of information may be collected through the Website and our Services: Personal Information and Non-Personal Information. This Privacy Policy does not extend to the collection, use or disclosure of Non-Personal Information (as defined further below).

“Personal Information” is any information about an identifiable individual, such as your name, telephone number, address, location, e-mail address, and credit card information, as well as any of your preferences. At the time of collection, We will clearly identify the information being collected and the purposes for which it will be used. Non-Personal Information is collected or derived by Us in the course of operating this Website and the Services. We may collect Personal Information when you register for an account on the Website, App and/or Services, during communications with you and/or when you make purchases through the Services, through user support, and/or by way of user surveys. 4.1 All Users.

Information you provide to us: For all Users, we collect Personal Information when you voluntarily provide such information to the Services, such as when you register for access to the Services, contact us with inquiries, respond to one of our surveys or browse or use certain parts of the Services. The Personal Information we may collect includes without limitation your name, address, e-mail address, phone number and other information that enables Users to be personally identified. We may also request and collect information about your preferences, as they relate to the Services.

Information we automatically collect: We also automatically collect certain technical data that is sent to Us from the computer, mobile device and/or browser through which Users access the Services (“Automatic Data”). Automatic Data, includes without limitation, a unique identifier associated with your access device and/or browser (including, for example, your Internet Protocol (IP) address) characteristics about your access device and/or browser, statistics on your activities on the Services, information about how you came to the Services and data collected through cookies and other similar technologies.

When you register for the Services or otherwise submit Personal Information to Us, we may associate other Non-Personal Information (including Non-Personal Information we collect from third parties) with your Personal Information. 4.2 Buyers and Vendors.

As a Buyer or a Vendor, We will collect additional information from you. We will collect necessary financial information such as your credit card number and Paypal information. We will also collect personally identifying information such as your name, telephone number, address, location, and e-mail address.

Other Users will only be able to view certain personally identifying information which you choose to allow, such as your business or user name, contact information, location, and certain other biographical information.

Tamborileo uses third-party payment processors like Paypal to process payment transactions (“Payment Processor”). Buyers and Vendors are required to provide valid credit card and billing information (“Billing Information”) to Tamborileo and the Payment Processor when making purchases through the Tamborileo Service. The collection, use and disclosure of all Personal Information by the Payment Processor is governed by the Payment Processors’ terms of use and privacy policies.

5. How We Use Your Personal Information

We collect and use the Personal Information we collect in a manner that is consistent with this Privacy Policy. We may use the Personal Information as described below.

5.1 Specific Reason.

If you provide Personal Information for a certain purpose, we may use the Personal Information in connection with the purpose for which it was provided. For instance, if you contact us by e-mail, we will use the Personal Information you provide to answer your question or resolve your problem and will respond to the e-mail address from which the contact came.

5.2 Access and Use.

If you provide Personal Information in order to obtain access to or use of the Services or any functionality thereof, we will use your Personal Information to provide you with access to or use of the Services or functionality and to monitor your use of such Services or functionality. For instance, if you supply Personal Information relating to your identity or qualifications to use certain portions of the Services, we will use that information to make a decision as to granting you access to use such Services and to monitor your ongoing qualification to use such Services. • To connect Buyers and Vendors;
• To collect funds relating to a transaction from Buyers in escrow;
• To pay out escrow funds relating to a transaction to Vendors; and
• To customize Users’ experience and show you relevant information.

5.3 Service Development and Improvement.

We may use your Personal Information to help us improve the content and functionality of the Website, App and Services, by better understanding how our Users interact with the Website, App and Services. We also collect statistics about use of the Services purchased through the Website. This information is used to monitor and improve the Services. This information will be kept confidential; however, aggregate statistics that do not personally identify an individual will be kept by Us and such aggregate statistics may be made available to third parties.

5.4 Security.

We use Personal Information to verify the identity of our Users, when necessary.

5.4 Marketing.

We may use your Personal Information to notify you of promotions or other services that may be of use to you. We will only send you electronic marketing messages in compliance with anti-spam legislation. You can unsubscribe from these messages at any time.

5.5 Community Features

Some community features, such as our blog, require you to enter certain Personal Information such as your name and email address. This information, along with any other information you choose to share, will be made publicly available and is visible to anyone browsing the Website.

5.6 Other Purposes.

Tamborileo may provide Personal Information collected from you, to its service providers as necessary to enable the service provider to perform its obligations to Us. Our servers are located in the United States, Canada and Japan (although this location may change from time to time) and your Personal Information may be transferred to and processed in Ireland. Accordingly, it may become available to the government of the United States, Canada and Japan or its agencies under a lawful order, irrespective of the safeguards We have put in place for the protection of your Personal Information. By using our Website, App and Services, you consent to the hosting of your Personal Information in Ireland. We reserve the right to store and process Personal Information in another location, and will use commercially reasonable efforts to provide you with reasonable advance notice of any such changes in the processing location.

7.1 Important Exceptions.
